The criminal case remains pending.
Incident Details
According to the Sarasota County Sheriff’s Office incident report, deputies responded shortly after 2:00 a.m. on March 1 to Gateway Live following a reported battery.
Investigators stated that the female victim identified Dutton as the individual who allegedly assaulted her.
According to the report:
- The victim told deputies Dutton had been arguing with several patrons and staff members outside the establishment.
- She reportedly asked what was happening before Dutton allegedly began yelling at her.
- The victim stated she attempted to walk away but alleged Dutton followed her, wrapped an arm around her neck, and pulled her to the ground.
- Investigators reported her head struck a concrete parking block during the fall.
- The report further alleges Dutton then stomped twice on the right side of her face.
- The victim reported briefly losing consciousness and later complained of jaw pain and loose teeth.
Deputies documented additional injuries that included abrasions to the victim’s face, chin, elbow, and hand.
The victim was transported by ambulance to a local hospital. According to the incident report, medical personnel advised deputies that she possibly suffered a broken jaw, although additional imaging was needed to determine the extent of the injuries.
Witness Statements
According to the sheriff’s office report, at least one eyewitness provided an account that generally corroborated the victim’s allegations.
The witness reportedly told deputies that Dutton grabbed the woman, slammed her to the ground, and then kicked her in the face twice.
The witness further stated that several bystanders intervened, physically pulling Dutton away from the victim and striking him until the alleged assault stopped.
As with all witness accounts in pending criminal cases, these statements remain allegations that have not been tested in court.
