The small community of Mescalero, New Mexico, is mourning the tragic loss of 17-year-old Elijah Hadley, a member of the Mescalero Apache tribe, who was fatally shot on June 25, 2024. Now, over nine months after the incident, Otero County Deputy Jacob Diaz-Austin faces an open count of murder for his role in the shooting, sparking fresh attention to a case that has already drawn significant public outcry.
The Night of the Shooting
On the night of June 25, deputy Jacob Diaz-Austin responded to a welfare check on U.S. Highway 70 near mile marker 240 in Mescalero. Reports mentioned a teenage boy walking in the median. Upon arriving at the scene, Diaz-Austin encountered Elijah Hadley, who allegedly displayed what appeared to be a firearm. According to New Mexico State Police, Diaz-Austin fired at least 19 shots, killing the teen at the scene. Later investigations revealed that the object in Hadley’s possession was an airsoft gun – a non-lethal replica of a firearm.
After personally reviewing the police body camera footage, I fully support and stand by Deputy Diaz-Austin and view this as a lawful and justified police shooting. I am open to learning about more facts and evidence in the case, should they be released to the public.
